1. Introduction & Scope
These Advertiser Terms & Conditions ("Advertiser Terms") govern the use of the Manzil platform by all persons or entities registering, publishing listings, or advertising properties as agents, agencies, developers, owners, or advertisers.
Manzil is a real estate technology platform operated by Productive Digital Agency (SMC-Private) Limited ("Company", "Manzil", "we", "us").
These Advertiser Terms apply in addition to Manzil’s Terms & Conditions, Privacy Policy, Disclaimer, and Listing & Content Policy. In case of conflict, these Advertiser Terms shall prevail for Advertisers.
2. Definition of Advertiser / Agent
Very Important Legal Clarification:
“Advertiser” means any independent real estate agent, agency, developer, owner, or other person or entity that publishes listings or promotional content on the Platform.
The term “Agent” is a descriptive label only and does not create any employment, partnership, or agency relationship with Manzil.
Advertisers are not employees, representatives, partners, or legal agents of Manzil.
3. Independent Status of Advertisers
- Advertisers operate independently and at their own risk.
- Advertisers have no authority to bind or represent Manzil.
- Advertisers may not claim endorsement or authorization by Manzil.
- Manzil does not supervise or control real-estate activities.
4. Registration & Account Information
Advertisers must provide accurate and complete registration information, including name, contact details, location, and business information where applicable.
5. KYC / Identity Verification
5.1 Purpose of KYC
Manzil may request identity or business documents such as CNIC, NTN, or photographs solely for identity confirmation, fraud prevention, platform safety, and legal compliance.
5.2 Meaning of “KYC Confirmed”
“KYC Confirmed” means documents were reviewed for identity purposes only and does not verify property ownership, listing accuracy, or professional competence.
5.3 Accuracy of Documents
Submission of false or forged documents may result in immediate suspension or permanent termination without refund.
6. Advertiser Responsibilities
- Ensure legal authority to advertise properties.
- Provide accurate, lawful, and non-misleading listings.
- Respect intellectual property and third-party rights.
- Comply with applicable real-estate and advertising laws.
7. Compliance With Laws
Advertisers are solely responsible for complying with all applicable laws, licenses, tax obligations, and regulations.
8. Fees, Subscriptions & Payments
Fees charged by Manzil are for platform and advertising services only and do not guarantee leads, responses, or transactions.
9. Prohibited Conduct
- Fake, misleading, or fraudulent listings
- Misrepresentation of ownership or authority
- Impersonation, harassment, or spamming users
- Claiming verification or endorsement by Manzil
10. Suspension, Removal & Termination
Manzil may suspend or terminate Advertiser accounts without notice in cases involving fraud, false information, or policy violations.
11. Data Retention & Cooperation
Manzil may retain Advertiser data for legal, security, or regulatory purposes and cooperate with lawful authorities when required.
12. No Liability of Manzil
Manzil is not liable for disputes, transactions, losses, or claims arising from Advertiser conduct.
13. Indemnification
Advertisers agree to indemnify and hold harmless Manzil and its operators from any claims or liabilities arising from breaches of these Terms or violations of law.
14. Changes to Advertiser Terms
Continued use of the Platform after updates constitutes acceptance of the revised Advertiser Terms.
15. Governing Law & Jurisdiction
These Advertiser Terms are governed by the laws of Pakistan. Courts of Pakistan shall have exclusive jurisdiction.
